By creating an account on BarryBalto, accessing our website, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, as well as our Privacy Policy. If you do not agree to these terms, you must not use the BarryBalto platform. These terms apply to all users, including pet parents, campaign creator accounts, fundraising supporters, and visitors who browse the platform without an account.

We reserve the right to modify these Terms of Service at any time. When we make changes, we will post the updated terms on this page with a revised "Last updated" date. Your continued use of BarryBalto after any changes constitutes your acceptance of the new terms. We encourage you to review these terms periodically to stay informed of any updates.

2. Account Registration & Responsibilities

To use certain features of BarryBalto, you must create an account. When registering, you agree to provide accurate, current, and complete information, including a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account by contacting us through our Contact Page.

You must be at least 13 years old to create an account on BarryBalto. Each user is limited to one personal account, though you may create profiles for multiple pets within that account. Campaign creator accounts are subject to additional requirements (200+ followers) and are governed by our Campaign Creator Program guidelines. Misrepresenting yourself as a campaign creator is strictly prohibited and will result in immediate account termination.

3. Community Guidelines

BarryBalto is built on respect — for animals and for each other. To maintain a safe and welcoming environment for our community, all users must adhere to the following guidelines. Content that depicts or promotes animal cruelty, neglect, or abuse in any form is strictly prohibited and will be removed immediately, with the offending account subject to permanent suspension. We have zero tolerance for content that endangers animals.

We expect all users to treat each other with kindness and respect. Harassment, bullying, hate speech, discrimination, and threatening behavior will not be tolerated. Spam, misleading content, impersonation of campaign creators or organizations, and any attempt to deceive or exploit members of our community are violations of these terms. BarryBalto is a positive space for animal lovers, and we are committed to keeping it that way.

4. Content Ownership & Licensing

You retain ownership of all content you create and share on BarryBalto, including pet photos, videos, comments, and profile information. By posting content on the platform, you grant BarryBalto a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and display your content solely for the purpose of operating and promoting the BarryBalto platform and its features, including our campaign creator program and community fundraising initiatives.

You represent and warrant that you have all rights necessary to grant us this license, and that your content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party. If you believe that your copyrighted content has been posted on BarryBalto without your authorization, please submit a DMCA takedown notice to legal@barrybalto.com with the required information, and we will address it promptly.

5. Campaign Creator Accounts

BarryBalto offers a Campaign Creator Badge for users who have 200+ followers and wish to create fundraising campaigns for pet-related causes. Users with 200+ followers can create fundraising campaigns. The Campaign Creator Badge is a trust signal that helps our community identify authentic campaign accounts and causes. Misuse of the campaign badge, including impersonating a campaign creator or misrepresenting a cause, is a serious violation of these terms and will result in immediate removal of the badge and potential account suspension.

Campaign creator accounts are expected to maintain accurate and up-to-date information about their fundraising campaigns, goals, and progress. BarryBalto reserves the right to revoke campaign creator status at any time if an account is found to be in violation of these terms or if the campaign details are no longer valid.

6. Prohibited Activities

The following activities are strictly prohibited on BarryBalto and may result in content removal, account suspension, or permanent ban: posting content that depicts or promotes animal cruelty, abuse, or neglect; selling animals through the platform; impersonating other users, campaign creators, or organizations; engaging in harassment, bullying, or threatening behavior; distributing spam, malware, or malicious links; using the platform for unauthorized commercial purposes; violating any applicable local, state, national, or international law; and attempting to circumvent security measures or gain unauthorized access to other accounts or systems.

We take these prohibitions seriously because our community's safety and the welfare of animals are our top priorities. If you encounter any content or behavior that violates these terms, please report it immediately using the reporting tools available on the platform or by contacting our moderation team through the Contact Page.

7. Disclaimer of Warranties

BarryBalto is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components. We do not guarantee the accuracy, completeness, or reliability of any content posted by users, including campaign profiles, fundraising descriptions, or cause information. Users are encouraged to independently verify information before making any decisions based on content found on the platform.

8. Limitation of Liability

To the fullest extent permitted by law, BarryBalto and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform. This includes, but is not limited to, damages for loss of data, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from or related to the platform shall not exceed the amount you have paid to BarryBalto, if any, during the twelve months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms of Service, fraudulent activity, impersonation of a campaign creator or organization, or conduct that is harmful to other users, animals, or the BarryBalto community. Upon termination, your right to use the platform will immediately cease, and we may delete your account and associated data in accordance with our retention policies.
